TERMS AND CONDITIONS
1. Acceptance of Orders
Unless otherwise specifically agreed to in writing and signed by an authorized person of Ultra Strength USA (hereafter referred to as “Seller”), the following terms and conditions shall apply to sales resulting from Seller's acceptance of Buyer's order for goods, products, services, or any other materials. Buyer's failure to object to the terms outlined in this document shall be conclusively presumed to be acceptance of all terms set forth. Acceptance of Buyer's order is subject to credit approval. In situations such as the development of unsatisfactory credit, the order may be cancelled by Seller at any time upon notice to Buyer without liability.
2. Price
Prices are subject to change in response to supplier price increases. Prices are also subject to change by Ultra Strength USA when Buyer reschedules or reconfigures its order. Applicable prices are those in effect at the time of shipment. Any taxes or other government charges which may apply to any part of Buyer's order will be paid by Buyer to Seller unless Buyer furnishes Seller with a tax exemption document appropriate to the transaction. Any freight rates, prepayment of freight by Seller on behalf of Buyer, or tariffs will be paid by Buyer in addition to the purchase price.
3. Payment
Ultra Strength USA has several convenient options for you to choose from. We accept Visa, MasterCard, American Express, cash, wire transfer, money order, direct deposit and company check from qualified businesses. Terms of payment are net 5 days from the invoice date unless stated differently on the Seller’s invoice. Prices of products do not include taxes, freight, handling, or other similar charges which are the sole responsibility of the Buyer. Seller reserves the right to modify terms prior to shipment, require payment in advance or cancel any order by reason of Buyer’s credit worthiness. Late payments shall bear interest at the rate of 1.5% per month (18% annual). In no event shall Seller charge interest above the maximum rate allowed by law.
4. Shipping and Delivery
In the absence of prior instructions from the Buyer, the Ultra Strength USA will select the carrier for shipment. All delivery dates are approximate. Because delivery dates depend upon our supplier’s inventory, production, shipping schedules and other factors, actual delivery dates may differ substantially from those quoted. Ultra Strength USA uses U.S. Postal Service for all ground shipments unless otherwise specified. Products will be packed and packaged using reasonable practices for commercial one-way shipments. Shipping charges, including those prepaid by Seller on behalf of Buyer, will be paid by Buyer.
5. Freight Damages & Shortages
If product is received from Ultra Strength USA that has been damaged in shipping, keep all packaging material and contact the carrier. The customer must make claims for loss or damage in transit. Ultra Strength USA reserves the right to ship plus or minus 10% unless otherwise stated on all orders. Claims for shortages or over shipments must be made within 10 days after receipt of shipment.
6. Purchase Order Changes
Buyer may not change orders without written consent from Seller. Any changes or revisions to specifications, orders or shipping dates may result in shipping delays and additional cost to Buyer.
7. Cancellations
All non-stocked, special order and custom assemblies are Non-Cancelable and Non-Returnable. An Ultra Strength USA customer service representative must authorize any cancellation. Canceling an order may cause a price adjustment to reflect actual usage.
8. Returning Product
Products will be considered accepted by the Buyer unless notice of rejection is given by the Buyer within ten (10) days of shipment date. Credit will not be allowed for products returned without prior consent. No return of products will be accepted without a Return Materials Authorization number issued by Ultra Strength USA. A complete description stating the reason for the return must be included with the returned products. The returned items must be in the original packing, in original condition and shipped by prepaid freight to Seller’s warehouse. Non-Cancelable, Non-Returnable products are non-returnable. Call 1(626) 570-9559 and ask for a customer service agent to give you a Return Merchandise Authorization number. Returns are subject to inspection prior to credit being processed.
10. Limited Warranty
All Ultra Strength USA products carry a 30-day satisfaction guarantee. Always contact Ultra Strength USA first to verify that the given guarantee or warranty applies and to obtain the authorization number within 30 days of the receipt date. All returned merchandise must be in the original packaging with the authorization number clearly printed on the outside of the package.
